LPG Partner Robert Giacovas and LPG Associate Courtney Lanzalotto prevailed on an appeal before the United States Court of Appeals, Second Circuit on behalf of a client that provides community development financial services and is wholly owned by a federally recognized Indian Tribe. The Second Circuit affirmed the District Court’s dismissal of a complaint seeking recovery under a limited recourse promissory note alleging causes of action for default, breach of contract, a breach of the covenant of good faith and fair dealing, and securities fraud.
